Terms of Use

These Terms of Use govern access to and use of the PoolUp97 platform. Any person using the platform acknowledges having read and accepted these Terms without reservation.

1. Platform Overview

PoolUp97 is a digital platform that connects private pool owners, hereinafter referred to as “Hosts”, with people wishing to reserve these spaces, hereinafter referred to as “Users”.

PoolUp97 acts exclusively as a technical intermediary and is not a party to the agreement concluded between the Host and the User.

2. Account Creation

Certain platform features require the creation of a user account.

Users agree to provide accurate, complete and up-to-date information when registering and to keep such information updated throughout their use of the platform.

Login credentials are strictly personal. Each user is responsible for maintaining their confidentiality and for all activity carried out through their account.

3. Identity Verification

To ensure user safety and prevent fraud, PoolUp97 may require Hosts and/or Users to verify their identity.

This verification may require the submission of identity documents, supporting documents or additional information.

Information provided must be accurate, complete, current and authentic.

PoolUp97 reserves the right to suspend or delete any account containing inaccurate, incomplete, expired or fraudulent information.

4. Host Obligations

• publish accurate and truthful listings;
• keep availability calendars up to date;
• honor confirmed reservations;
• provide a pool that matches the published information;
• comply with applicable regulations;
• hold all necessary authorizations to operate their pool.

5. User Obligations

• respect the premises and equipment made available;
• respect the reserved time slots;
• follow the instructions provided by the Host;
• not exceed the authorized number of participants;
• use the facilities responsibly.

6. Safety and Supervision

The supervision of children, minors and vulnerable persons remains the sole responsibility of the parents, legal representatives or accompanying adults present during the reservation.

Users agree to comply with all safety instructions applicable to the use of a swimming pool.

Swimming involves inherent risks for which each participant assumes responsibility.

7. Prohibited Activities

The following are strictly prohibited:

• publishing false or misleading information;
• fraud or attempted fraud;
• circumventing the reservation system;
• illegal activities;
• dangerous or violent behavior;
• any infringement of other users’ rights.

8. Account Suspension or Deletion

PoolUp97 may suspend or delete an account, particularly in the event of:

• violation of these Terms of Use;
• fraud or attempted fraud;
• behavior that endangers other users;
• forged or non-compliant documents;
• failure to comply with applicable legal obligations.

9. Insurance

Each Host is responsible for ensuring that they have the necessary insurance coverage for their activity and for the risks associated with making their pool available.

PoolUp97 does not automatically provide insurance coverage for damage that may occur during a reservation.

10. Intellectual Property

Texts, logos, trademarks, photographs, graphics, interfaces, software and content available on the platform are protected by intellectual property laws.

Any unauthorized reproduction, distribution or use is prohibited.

11. Service Availability

PoolUp97 endeavors to ensure the availability of the platform but does not guarantee permanent and uninterrupted access to the services.

Temporary interruptions may occur for maintenance, updates or events beyond PoolUp97’s control.

12. Force Majeure

PoolUp97 shall not be held liable in the event of force majeure preventing the normal performance of the services.

Force majeure events include, but are not limited to, hurricanes, tropical storms, floods, earthquakes, volcanic eruptions, fires, pandemics, widespread network outages or exceptional administrative decisions.

13. Personal Data Protection

Personal data is processed in accordance with PoolUp97’s Privacy Policy and the General Data Protection Regulation (GDPR).

14. Modification of the Terms

PoolUp97 reserves the right to modify these Terms of Use at any time to reflect legal, regulatory or technical developments.

15. Applicable Law and Jurisdiction

These Terms of Use are governed by French law.

In the event of a dispute, the parties shall first seek an amicable solution before initiating any legal proceedings.
